Rights claims are generalized moral claims about how humans should treat one another, whether in this society or any other. They are discovered, not created. A true rights claim is a right.
My comment on Jason’s post was a bit snarky. I said, “How do you discover a right? Is there a test? An instrument?”
A bit of snark, yes, but it’s a serious question. Because I see this claim a lot – the idea that rights, or even morality itself, is something that you discover. What I see less often is a serious argument to justify this claim.
So, open thread time: Do you think that rights are discoverable? If so, how?
